PLANS for a house to be built on the former Ballplay Lawn Tennis Club in Moffat will go before councillors next week, with officers recommending approval.
The application by Mr Gourlay would see a dwelling house built and the formation of a shared lay-by on one of the club’s three tennis courts with external landscaping too.
The 597 square metre site is located on the northern side of Ballplay Road and sits within the Moffat Hills Regional Scenic Area.
It is classed as medium risk area for surface water flooding according to the Scottish Environmental Protection Agency (SEPA) who have objected to the plans on those grounds.
However there have been no objections from Scottish Water, council officers or members of the public, therefore members are being advised to approve the application subject to conditions at their meeting on Wednesday January 29.
A report on the matter concludes that as planning permission in principle already exists for the area, SEPA’s objection, while ‘noted and understood’, does not override that.
It also points out that mitigation measures against possible flooding have been incorporated into the proposal and concludes therefore: “It is considered that it would be unreasonable to refuse on flood risk grounds.”
After next week’s meeting, it will be up to Ministers to decide if they want to ‘call in’ the application.
